Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, Discord integrations, and related services (collectively, the “Service”) operated by Solaris LLC d/b/a Banana Options (“we,” “us,” or “our”).

1. Acceptance

By accessing or using the Service, creating an account, or completing a purchase, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. The Service is not directed to children.

3. Nature of the Service

The Service provides market data tools, educational content, community features, and optional analyst commentary for informational and educational purposes only. We are not a broker-dealer, investment adviser, commodity trading adviser, or fiduciary. Nothing on the Service is a recommendation or solicitation to buy or sell any security, option, future, or other instrument.

4. Subscriptions and billing

Paid plans are billed through Stripe (or our payment processor). Fees, renewal terms, and cancellation are disclosed at checkout. Except where required by law, fees are non-refundable. We may change pricing with notice as described at checkout or on the Service.

5. Accounts and acceptable use

You are responsible for your account credentials and all activity under your account. You may not scrape, resell, or redistribute market data except as expressly permitted; reverse engineer the Service; harass other users; or use the Service unlawfully.

6. Third-party data and delays

Market data may be delayed, incomplete, or inaccurate. Your plan may include delayed data. We do not guarantee timeliness, accuracy, or availability of any data feed.

7. Intellectual property

We and our licensors own the Service and its content. You receive a limited, non-exclusive, non-transferable license to use the Service for personal or internal business purposes according to your plan.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR TRADING LOSSES, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

10. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the Service or violation of these Terms.

11. Governing law

These Terms are governed by the laws of Illinois, without regard to conflict-of-law rules, except where mandatory consumer protections apply in your jurisdiction.

12. Changes

We may update these Terms. Material changes will be posted on the Service. Continued use after changes constitutes acceptance.
